Moderna Wins UK Appeals Court in Covid-19 Patent Case Against Pfizer/BioNTech

The UK Court of Appeal ruled in favor of Moderna, confirming the validity of its EP'949 patent and finding it was infringed by Pfizer/BioNTech's COVID-19 vaccine, Comirnaty23.

This decision upholds a previous ruling by the UK High Court that also found the Moderna patent valid and infringed4.

The case marks the first global second-instance decision validating one of Moderna's core mRNA patents2.

The court did, however, find another Moderna patent invalid in a separate aspect of the dispute1.

Moderna has achieved similar favorable rulings in other European jurisdictions, including in Germany and at the European Patent Office, though appeals in those cases are ongoing2.
